When an environmental safety and health issue exists, there are reasons. These reasons dictate the most appropriate remedial responses.
For example:
Removing mold from a material, or disposing of a mold contaminated material will not address why there was mold in the first place; If the conditions that lead to the mold growth are not changed, new mold will appear. The most effective solution will also address why the mold was present, and eliminate the involved conditions to prevent reoccurrence.
When an injury occurs, the causative factors must be understood to determine the best measures to prevent further injuries. The injury may have been due to workplace environment, worker training, operator error, equipment malfunction, or off site/personal activities, etc.
Investigation of causative factors also provides liability protection. Performance of Due Diligence can provide vital protection. Without Due Diligence, an Innocent Land Owner Defense is not feasible. Without Due Diligence, Tort Liability issues, and Willful and Negligent cases, are almost impossible to defend. This applies to commercial, as well as residential settings.
